Court marriage in Ahmedabad: what it actually means

"Court marriage" is the everyday name for getting married through a government officer instead of (or in addition to) a religious ceremony. In Gujarat there are two legal routes that couples usually mean when they say court marriage:

  • Marriage under the Special Marriage Act, 1954. A civil marriage solemnised before the Marriage Officer of your district. Religion and caste do not matter, nobody has to convert, and no religious ceremony is needed. You give a notice, wait for the 30-day notice period, and then marry before the officer with three witnesses. Read the full Special Marriage Act process.
  • Religious ceremony followed by registration. If both partners are Hindu, Buddhist, Jain or Sikh, the marriage can be performed under the Hindu Marriage Act, 1955 (for example at an Arya Samaj mandir or a temple) and then registered with the Registrar of Marriages under the Gujarat Registration of Marriages Act, 2006. Read about marriage registration in Ahmedabad.

Both routes end with an official marriage certificate that is valid for passport, visa, bank, insurance, name change and every other legal purpose. Which one is right for you depends on your religions, where you live, your timeline and your family situation — that is exactly what we work out in the first consultation.

Who can have a court marriage?

  • The groom must be at least 21 years old and the bride at least 18 years old.
  • Neither partner can have a living spouse — a previous marriage must be ended by a divorce decree or the death of the spouse.
  • Both must be capable of giving valid consent.
  • The partners must not be within the degrees of prohibited relationship, unless a custom governing them permits it (this exception applies under the Hindu Marriage Act).

Parental consent is not a legal condition for a valid marriage between two adults in India. That said, Gujarat amended its marriage registration rules in 2026 to ask for details about parents and to notify them during registration. We explain exactly what this means for your case and how the process runs today — see our guide to the 2026 Gujarat rule changes.

Documents you will need

In most cases each partner needs proof of age (birth certificate, school leaving certificate or passport), proof of identity and address (Aadhaar card, voter ID, passport or driving licence), recent passport-size photographs, and an affidavit about date of birth, marital status and nationality. Divorced or widowed partners also need the divorce decree or death certificate. Witnesses need their own ID and address proof. The complete documents checklist lists everything, including what NRIs and foreign nationals need.

How long does a court marriage take?

Under the Special Marriage Act there is a mandatory 30-day notice period, so the full process usually takes a little over a month from the day the notice is filed. Registration of a marriage already performed under the Hindu Marriage Act follows the Registrar's own verification timeline, which in Gujarat now includes a waiting period under the 2026 rules. Be careful with anyone who promises a "same-day court marriage certificate" — a ceremony can happen on the same day, but a lawful government certificate cannot skip the steps the law requires. See the step-by-step procedure.

Why use a court marriage lawyer?

You can file the papers yourself, but most delays happen because of small mistakes: a mismatch in the spelling of a name, an address proof that does not establish 30 days' residence, a wrongly worded affidavit, or a witness without the right ID. Inter-caste and inter-religion couples, NRIs, and anyone who has been married before face extra steps. An advocate makes sure the application is accepted the first time, deals with the Marriage Officer or Registrar, answers any objection that is raised, and — where a couple faces threats — can approach the court for protection.

Questions

Court marriage in Ahmedabad — common questions

What is the minimum age for court marriage in India?

The groom must be at least 21 years old and the bride at least 18 years old on the date of marriage.

What documents are required for court marriage in Ahmedabad?

Proof of age, ID and address proof for both partners, photographs, affidavits on age and marital status, and ID of witnesses. Divorced or widowed partners also need the divorce decree or death certificate. See the full checklist.

How long does a court marriage take?

Under the Special Marriage Act, about 30–35 days, because of the compulsory 30-day notice period. Registration of a religious marriage in Gujarat depends on the registrar's verification and waiting period under the 2026 rules.

Is parents’ consent required for court marriage?

No. Parental consent is not a legal requirement for a valid marriage between adults. Gujarat's 2026 registration rules ask for parent details and notify parents during registration, which we explain before you file.

Can two people of different religions do a court marriage?

Yes. Under the Special Marriage Act, 1954, partners of any religion can marry without either of them converting.

What is the fee for court marriage in Ahmedabad?

There is a small statutory government fee plus our professional fee, which depends on your route and situation. We tell you the total upfront, in writing, before starting.
